Cancer Misdiagnosis Lawsuit

The Des Moines Register reported, “An eastern Iowa woman who claims doctors failed to diagnose her breast cancer in 2002 will be allowed to pursue a lawsuit against two doctors under an Iowa Supreme Court ruling Friday that said she filed her case within the required two-year window” defying a ruling by a “Scott County judge and the state appeals court, both of which found that Pamela Rock did not sue until after the statute of limitations had expired.”

The AP also reported the story but added that the plaintiff, Pamela “Rock, could not have known, and would not have known through reasonable diligence of her injury, the worsening of her cancer, or its cause in fact, the misdiagnosis, until she had been properly diagnosed with cancer at the earliest,' the high court wrote in its ruling.”
