Florida Court Strikes Down Cap On Non-Economic Damages

Many states have limits on the amount of non-economic damages, commonly known as pain and suffering. Rather than allow the jury to decide the proper amount of money to award for this part of a case, the legislatures in these states have decided arbitrarily to set a limit.

The Florida Court has struck down this limit in Florida. Now, those who have been injured for life by the negligence of another, can return the decision to the jury where it belongs.

Unfortunately, these limits still exist in Maryland.
