Stimulus Bill Includes New HIPAA Provision

State attorneys general could soon have the authority to pursue damages for violations of the federal Health Insurance Portability and Accountability Act, under a proposed economic stimulus bill currently before the Senate. Business groups have blasted the inclusion of the provision, saying it would allow attorneys general to contract with plaintiffs' attorneys seeking damages for HIPAA violations. The provision also allows state attorneys general to seek attorney fees and costs associated with HIPAA-related actions. Marcia Coyle, 02/03/2009
