Why Are Birth Injury Cases So Expensive?

Almost every day, a potential client will ask me why birth injury cases are so expensive? Let's talk about why that is.

First, the costs of obtaining the necessary medical records, films, school records, therapy records, and other records can cost hundreds of dollars.

Once the records are gathered, they need to be sent to various medical doctors, known as medical experts. The law of Maryland and DC require that medical doctors be willing to come to come court and to testify to all the elements of a birth injury case:

  • Medical negligence
  • Causation
  • Damages

In a birth case, an obstetrician and/or a labor and delivery nurse will be consulted.  Their role is to give opinions as whether medical negligence occurred. 

Neurologists and radiologists must review the records to testify as to whether the negligence caused cerebral palsy or developmental delays.

Damages experts like life care planners and economists have a role in detailing and calculating the amount of past and future medical care is required for a child.

There can be other experts that need to get involved like developmental pediatricians or genetic experts.

These medical doctors typically charge between $500-800 dollars depending on their specialty. It can take many, many hours to review medical records, give testimony in a pre-court deposition and in court if the case does not settle.

On top of these costs, case expenses like filing fees, deposition costs, travel expenses and the like go into the amount.

The bottom line is that a birth injury case can cost $150,000 to $200,000 dollars.

In a birth injury case, the lawyers put up those costs not the client. Only if the case is won, does the client pay a fee and expenses. This would deducted from the total amount recovered if the case is successful.
