Why Do I Have to Pay Back Medicare Or Medical Assistance Out of My Medical Malpractice Settlement?

If your medical bills are paid for by Medicare or Medical Assistance, then each has a right under the law to be paid back the money which has been spent on your care and is related to the case.

Therefore, it is important to obtain the amount of the medical bills that Medicare or Medical Assistance is claiming as being related to the case. This should be done as early in the case as possible.

When you speak with a lawyer about your case, let the lawyer know whether you are a Medicare or Medical Assistance recipient.
